About The Probate Process in Nebraska
- Under a new exemption in our probate rules, the court procedures for probate can be avoided if the estate of a deceased person is worth less than $50,000. An affidavit may be filed instead of going through court procedures, as outlined in the forms in the Nebraska Probate Code.
- There is also an exemption for larger estates, if their property is held in certain ways, allowing it to be transferred outside of probate; collectively, this is called “non-probate” transfer, which is governed by parts of the Nebraska Probate Code, too.
